These Terms of Service ("Terms") govern your access to and use of the FiveStarJob field service management platform, including the website, web application, mobile apps and related services (together, the "Service"). By accessing or using the Service you agree to these Terms. If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.
1. The service
FiveStarJob is a multi-tenant software-as-a-service platform for managing field service operations, including jobs, scheduling, dispatch, estimates, invoicing, customer communication and related workflows. We may update, improve or change features of the Service over time.
2. Accounts and eligibility
You must provide accurate account information and keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. Accounts are for use by the business and individuals authorized by that business.
3. Acceptable use
- Do not use the Service for any unlawful, harmful or fraudulent purpose.
- Do not attempt to gain unauthorized access to the Service, other tenants' data, or related systems.
- Do not interfere with or disrupt the integrity or performance of the Service.
- Do not misuse messaging, calling or marketing features in violation of applicable law (including anti-spam and telemarketing rules).
4. Customer data and privacy
You retain ownership of the data you and your customers provide through the Service. For data processed on behalf of a business using FiveStarJob, that business is the data controller and FiveStarJob acts as a data processor. Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
5. Third-party services and connected accounts
The Service may integrate with third-party services (for example, payment processing, telephony and voice providers, and advertising or lead sources such as Google Local Services Ads). Your use of a connected third-party service is subject to that provider's terms. When you connect a Google account, our access to and use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements, as described in our Privacy Policy.
6. Fees
Where the Service is provided under a paid plan, fees, billing frequency and payment terms are those set out in your order or subscription. Unless stated otherwise, fees are exclusive of applicable taxes. Late or failed payments may result in suspension of the Service.
7. Intellectual property
FiveStarJob and its licensors own all rights, title and interest in and to the Service, including all related software, designs and trademarks. These Terms do not grant you any rights to our trademarks or branding. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription in accordance with these Terms.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, FiveStarJob will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Service.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if required to protect the Service or comply with law. On termination, your right to use the Service ends; data handling on termination follows our Privacy Policy. To delete your account, follow the steps on Delete your account.
11. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict-of-laws rules. The courts located in Alberta will have jurisdiction over any dispute arising out of or relating to these Terms or the Service.
